LOS ANGELES, CA, UNITED STATES, April 15, 2026 Shegerian Conniff LLP filed a complaint on behalf of Jenifer Mendoza and Wuanquiriam Pinto, whose employment with ABM Industry Group was wrongfully terminated.
Mendoza was hired by Magic Building Services in June 2024, a staffing agency that placed her at ABM Industry Groups. After working through Magic for five to six months, she cancelled her contract with the company to begin working for Labor Solutions, a company she was referred to by ABM manager Alejandra Lujan. From here, she performed cleaning services for ABM through her employment at Labor Solutions.
Pinto was hired directly by ABM Industry Groups as a janitor in July 2024. As a single mother of three, she relied on this role to provide stability for her family. Pinto noticed the demanding environment created by her supervisors, particularly Ivan Presa, very early on. A culture of fear at ABM made her feel constantly overworked and fearful of imminent termination.
Mendoza worked for AMB for several months without issues, and she was often scheduled to work overnight shifts from 2:00 am to 2:00 pm. However, her problems began when she started working with Zulmi Sandoval, a female cleaning staff member for ABM. Sandoval’s repeated inappropriate, sexual comments directed at Mendoza made her feel uncomfortable and unsafe in the work environment. In April 2025, Mendoza witnessed Sandoval rubbing Wuanquiriam Pinto’s buttocks in a clock-in room. Mendoza followed up with Pinto about this interaction, who noted that she had asked Sandoval to stop, but was ignored and harassed, nonetheless. Pinto noted that Sandoval consistently touched her by brushing up on her body as they worked and placing her hands on Pinto’s lower back, waist, and buttocks.
In addition, Lujan, a manager at ABM, consistently acted in a discriminatory manner towards Mendoza, Pinto, and other Latina employees, mocking their accents and treating them like they were mentally disabled because of their race. Lujan assigned the Latino cleaning staff heavier workloads than their non-Latina co-workers, threatening that if they did not comply, they should not be employed with ABM.
The harassment culminated in a complaint filed by Mendoza, Pinto, and eight others against Lujan and Sandoval, which was followed up by the HR department with written surveys that were not taken seriously.
On May 13, 2025, Pinto suffered a back injury and was denied accommodations to alternative positions and later placed on disability leave. Meanwhile, Lujan had filed a false report of her own against Pinto and others, claiming they had been behaving inappropriately in the workplace. Pinto was called into an interview to face these allegations during his disability leave, being forced to face her harasser in a space that was supposed to be confidential. On June 13, 2025, Mendoza was informed by Labor Solutions that her employment was terminated by ABM. Meanwhile, Sandoval and Lujan remained in their positions. Shortly after on July 17, 2025, ABM notified Pinto that she would be transferred out of ABM to an alternative location once her disability leave ended. Pinto later contacted HR seeking written confirmation of her displacement, which stated that Pinto’s conduct did not align with ABM’s policy values and the company had taken corrective measures. ABM refused to disclose whether disciplinary measures had been taken against other team members, and Pinto later learned that Sandoval was still employed at AMB and receiving work accommodations for a similar injury.
Hence, Mendoza and Pinto bring this action against the defendants for economic, non-economic, compensatory and punitive damages, pursuant to Civil Code section 3294, prejudgment interest pursuant to Code of Civil Procedure section 3291, costs, and reasonable attorneys’ fees pursuant to Government Code section 12965(b) and Code of Civil Procedure section 1021.5.
