In California, the act of breastfeeding is protected by law. California Civil Code Section 43.3 states that “Notwithstanding any other provision of law, a mother may breastfeed her child in any location, public or private, except the private home or residence of another, where the mother and the child are otherwise authorized to be present.” This means that nursing mothers have the right to breastfeed their babies in public places, including the workplace. Furthermore, California Labor Code Section 1030 requires employers to provide reasonable break time and private space, other than a toilet stall, for employees to express milk.
